Only the German Freight Forwarders’ Standard Terms and Conditions (ADSp) – latest version – shall apply to all business transactions.

In section 23 ADSp, these limit the statutory liability for damage to goods in accordance with § 431 of the German Commercial Code (HGB) for damage in the custody of the freight forwarder to 5 euros/kg; in the case of multimodal transports including sea transport from 2 SDR/kg and beyond this per claim or event to million or 2 million euros or 2 SDR/kg, whichever is higher.
